Understand the Rules for Using Our Platform as a Tourist or Guide
Welcome to Tourista’s Terms and Conditions
These Terms and Conditions govern your use of the Tourista platform, including our website (touristanyc.com) and mobile app, launching in July 2025. Tourista connects tourists with local guides for authentic travel experiences in destinations like NYC, Spain, Morocco, Algeria, France, and Japan. By accessing or using our platform, you agree to these terms, whether you’re a tourist booking a tour or a guide offering your services. If you do not agree, please do not use our platform. We may update these terms from time to time, and the latest version will always be available at this page.
Definitions
For clarity, here are some key terms used throughout this document:
- Tourista: Refers to our platform, including the website (touristanyc.com) and mobile app, operated by Tourista, based in NYC, NY.
- Tourist: An individual using Tourista to book local guides for travel experiences.
- Guide: A local guide offering tours or experiences through Tourista.
- Pioneer: A guide who joins Tourista’s early adopter program before launch, eligible for special rewards.
- Tour: A guided experience booked through Tourista, led by a local guide.
Using the Tourista Platform
Tourista provides a platform for tourists to book authentic local experiences with guides in various destinations. To use our platform:
- You must be at least 18 years old to create an account or book a tour.
- Tourists can browse guides, book tours, and communicate with guides through the app.
- Guides must provide accurate information about their tours, including pricing, availability, and meeting points.
- All users must respect local laws and regulations during tours, including safety and cultural norms.
- Tourista is not responsible for any disputes between tourists and guides but will assist in resolving issues where possible.
Pioneer Program for Guides
Tourista’s Pioneer Program rewards early adopters who join before our July 2025 launch. By registering as a pioneer at touristanyc.com/join-as-pioneer, guides agree to:
- Provide feedback on app features and user experience during the pre-launch phase.
- Receive zero commission on their first 5 tours booked through Tourista after launch, meaning they keep 100% of their earnings for those tours.
- Gain early access to the app and a “Pioneer” badge on their profile for priority visibility for the first 3 months after launch.
- After the first 5 tours, standard commission rates (to be determined) will apply.
Payments and Fees
Tourista facilitates payments between tourists and guides, ensuring a secure and seamless experience. For details on cancellations and refunds, see our Cancellation Policy page:
- Tourists pay for tours upfront through the app, and funds are held securely until the tour is completed.
- Guides receive payment within 5 business days after completing a tour, minus any applicable commission fees (except for pioneers’ first 5 tours).
- Tourista uses third-party payment processors (e.g., Stripe) to handle transactions, and users agree to their terms of service.
- All prices are in USD, and tourists are responsible for any currency conversion fees.
User Conduct and Responsibilities
All users must follow these guidelines to ensure a positive experience on Tourista:
- Do not use the platform for illegal activities or to promote harmful behavior.
- Tourists and guides must communicate respectfully and professionally through the app.
- Guides are responsible for ensuring their tours are safe, accurate, and as described in their listings.
- Tourists must arrive on time for tours and follow the guide’s instructions for safety and enjoyment.
- Tourista reserves the right to suspend or terminate accounts for violations of these terms.
Liability and Disclaimers
Tourista strives to provide a reliable platform, but there are some limitations to our responsibility:
- Tourista is not liable for any injuries, damages, or losses that occur during a tour. Users participate at their own risk.
- We do not guarantee the quality or safety of tours, though we vet guides for expertise and reliability.
- The platform may experience technical issues (e.g., downtime); Tourista is not liable for any inconvenience caused.
- All content on the platform, including tour descriptions, is provided “as is” without warranties.
